Compliance and Risk Management as Profit Protection
Industry challenges abound! Our Krewe will kick off the agenda with an alphabet tour overviewing some of the hottest issues we face today. Escalating fraud in deposits and payments, accelerating identity theft, and ongoing FCRA, TCPA, FDCPA SCRA and MLA risks. In the midst of the perceived enforcement action pause, stay alert to the higher litigation, state consumer protection oversight, and reputation risk. Be mindful of the five-year lookback for exams amidst the political pendulum swing. These hot spots deserve a level-set to set the tone for today’s demand for agile risk management.

Maximizing Partnerships: FinTechs, De Novo Banks, Skinny Charters and Traditional Partnerships
Financial services firms and institutions of all sizes are partnering up to provide high quality, innovative services amidst a volatile, competitive environment. We’ll map out the evolving terrain to identify the compliance implications of each of these relationships. It is critical to transform the perception of compliance and risk as the “Committee of No” into the reality of “Supportive Business Partners” ready to tackle the compliance and risk nuances each of these relationships bring to the table. Our Krewe will share pointers to strengthen your risk and compliance program to maximize risk mitigation of the unique TPRM risks posed by the innovative collaborations.

Loan Data and Integrity
Our industry, exam teams, litigators, and advocacy groups all have a “high need to know” a broad spectrum of loan details! Let’s do a quick recalibration of your data mapping to ensure you are accurately telling your story. Start with Call Report Data, applicable to every bank, and tighten up your mapping to Fair Lending Analytics. Next, we’ll align HMDA and CRA data for those institutions directly and indirectly impacted. As we have seen, even if you are not a HMDA or CRA Data Reporter, exam teams ask for sufficient data to conduct a Fair Lending exam. As a non-reporter, providing data similar in structure to the familiar HMDA and CRA schemas can help smooth out some of the exam prep sharp corners. We’ll round out the loan data journey with a look at the current version of DFA Section 1071’s Small Business Lending Rule. One way or another, more detailed loan data will be required.
Speakers:

- Carl Pry, Senior Advisor, Asurity Advisors
- Linda Ezuka, Founder, CRA Today and the CRA Hub

State Law Landscape
As federal baselines remain relatively stable, states are increasingly diverging in how they define and enforce consumer protection, licensing, fees, privacy, servicing, and unfair or deceptive acts standards—creating “50-state” compliance complexity that can shift quickly. We’ll also cover the rise of multi-state initiatives, including coordinated examinations, joint investigations, and harmonized rulemaking efforts that can accelerate supervisory expectations across jurisdictions. Participants will leave with best practices to manage state-law risk: a strong compliance management system, disciplined regulatory change monitoring, complaint and examination readiness, vendor oversight, and issue management across jurisdictions, products, and partners.

The Gift That Keeps on Giving: Mastering Flood Insurance Risk Management
Every. Single. Year. Flood insurance compliance makes the Feds’ hit lists of most frequently violated rules. Flood insurance risk is examined from two important perspectives, technical compliance and safety and soundness portfolio management. We will take a fresh look at some troublesome logistical challenges of flood determinations, mandatory flood insurance purchase amounts, understanding covered events and force-placed insurance. Our Krewe will also discuss the important potentially discriminatory climate risk referred to as “bluelining,” a climate version of harmful redlining practices. As institutions witness massive floods and fires ravaging our communities and our loan portfolios across the country, we must protect against discriminatory actions disproportionately harming low-income communities and communities already vulnerable to economic devastation following horrific climate events. There’s a lot wrapped up in this important subject, and we’ve got solutions!
